Somers arts fair virtual art exhibition 2021

Artwork entry online submission

  1. The Somers arts fair art exhibition will run as a virtual online art show via gallery 247.
  2. The online system for submissions will open from mid-July and entries close 5pm 8th
  3. All submissions will be made through the gallery 247 online entry system. Works accompanied by an image are more likely to be accepted.
  4. By submitting your works through our online process, you enter into an agreement with Somers arts fair (Somers primary school), hereafter referred to as “the organisers”, and you agree to comply with these terms and conditions.
  5. If a painting that has been submitted online is sold by the artist prior to acceptance, a substitute painting may be submitted in its place. No penalty or additional fee will apply.
  6. Artwork details can be edited through gallery 247 up until 8th The system is then closed to allow for exhibition curation and no changes are permitted after this date.
  7. Please ensure all details for your submissions are correct.
  8. Submissions are subject to gallery 247 terms and conditions.
  9. Selling artists must be aware of the gallery 247 money back guarantee and returns policy for buyers. By entering you agree to abide by these provisions: your money-back guarantee when you buy art work on line from gallery 247.

Submission and acceptance fees

  1. Submission and entry fees will be waived for donating artists. Donating artists must notify the organisers by email: art@somersartsfair.com, including the name of their donated artwork and a reserve price.
  2. A non-refundable submission fee of $5.00 per artwork (including GST) will apply, irrespective of the size of the artwork.
  3. Upon acceptance, a non-refundable acceptance fee of $10.00 per artwork (including GST) will apply.
  4. Each entrant will receive an invoice with payment details and all entry fees must be paid before the receiving day (see delivery guidelines below).

Commission and payment

  1. Somers primary school deducts 25% commission on any artwork sold.
  2. For donated artworks, 100% of the proceeds from the sale will go directly to Somers primary school.
  3. GST declaration - for taxation purposes, artists are required to supply an ABN or complete the declaration stating that they are a hobby artist and do not earn over $10,000 pa from their art. Without either of these, the government requires that 48.5% of payments due to artists be withheld.

Submission rules

  1. Each artwork must be available for sale. Artists must determine the price and include that price on the entry form which will then be used by the organisers to display for that work.
  2. Alterations to the price must be requested in writing to the organisers.
  3. Donated artworks provide a 100% contribution to the school and are gratefully accepted. It is the responsibility of donating artists to nominate a reserve price and ‘valued at’ price to assist with sales.
  4. Up to six artworks may be submitted for consideration. Each submission incurs a separate fee, and artists should be aware that regardless of the online nature of the exhibition, each entry will be subject to a pre-selection process.
  5. Artists should be aware of the shipping costs associated with their submissions.
  1. Pairs (diptych) or trios (triptych) will be accepted as one entry for one entry fee, however the total square area of both or all three works must fall within the limit prescribed at item 19 above (1 sq.m). The works will be hung together and sold as one item for the price quoted on the entry form.

  2. The selection panel who are appointed will consider all submitted works. The artist understands that the organisers of Somers arts fair have the final say, and that no correspondence will be entered into.
  1. The organisers reserve the right to reject any artwork. Any works that are inadequately framed, with inadequate means of hanging, damaged on arrival, oversize, of an inappropriate or pornographic nature (as so judged by selection panel), or wet paintings (as so judged by selection panel), will not be accepted. As this is a community event, works deemed to be offensive by the organisers will not be hung. The organisers reserve the right to withdraw any work at any time from the exhibition.

  4. Additional works: individual artists may at the discretion of the organisers, be invited to supply more than the maximum number of works.
  5. Artists will be notified which of their works have been accepted to be exhibited prior to the opening of the Somers arts fair show.
  6. No payments whatsoever will be made by the organisers for freight or other charges incurred in delivery or return of artworks.
  7. Insurance for artworks for the duration of the exhibition and during shipping if sold is the artist’s responsibility.
  8. Do not send you artwork to Somers arts fair. The artist acknowledges that if their artwork is accepted into the online exhibition, they do not send it to Somers arts fair. The artist will be notified by gallery 247 of where to send artwork if and when it has sold.
  9. Please note: pack & send is gallery 247s preferred shipping supplier.
  1. The organisers reserve the right not to accept an entry where no GST information is provided (see item 13 above), or where incomplete information is given.

Prizes and awards

  1. All accepted artworks will be considered for judging for prizes and awards. Each artwork is only eligible to win only one award category.
  2. The organisers’ and judges' decisions are final and no correspondence will be entered into. 

Artwork sales

  1. Artists will be notified by gallery 247 if their artwork has sold.
  2. Artists will be paid for sold artworks, excluding the 25% commission fee, within 4 weeks of the closure of the event. Remember to enter your dispatch (shipping details, method, date and tracking number) details or payment will be repelled.
  3. It is the artist’s responsibility to ensure that their bank details are correct in the gallery 247 system.
  1. The artist appoints the organisers as his or her agents for all purposes associated with the exhibition and auction and agrees to allow the organisers to offer all paintings for sale to the public at the price stated by the artist on the entry form.
  2. Artists must complete the GST declaration as part of the online entry process (refer item 13). Any applicable GST on the sale of a painting is the artist's responsibility. All marked prices are to be inclusive of any GST where applicable.

Shipping of sold artwork

  1. Gallery 247 will notify the artist when artworks have sold and will send the artist the delivery address and contact details of the buyer. It is the responsibility of the artist to arrange shipping and delivery.
  2. When submitting an artwork via gallery 247, the artists acknowledges that they will be asked to enter the cost of shipping their artwork to a buyer.
  3. The artist acknowledges that a buyer will pay the price that the artist has set for their artwork through gallery 247, plus the cost of shipping (that the artists has stipulated in their submission). It is very important for artists to ensure that their shipping costs are adequate to cover their costs. Neither Somers arts fair nor the buyer will be responsible for errors in shipping costs made by the artist.
  4. Two national organisations that ship artwork are Australia post and pack & send. Artists can check the Australia post website and use their calculator to estimate the cost of postage for the artwork to the buyer postage calculator & delivery times - Australia post (auspost.com.au) or contact them on 137678 from 8am - 6pm Monday to Friday. Please note that Australia post have size and weight limits for shipping. Artists can also contact the nearest pack & send to get a quote for shipping costs based on the size and weight of your artwork. Pack & send is a national drop-off service specialising in artwork transportation (pack & send - Australia’s best rated courier, freight & parcel delivery service (packsend.com.au).
  5. Artists will need to pay for their shipping upfront and then funds (price minus commission plus the shipping cost as set on your gallery 247 details) will be transferred to the artist’s nominated bank account by gallery 247.
  6. The artist indemnifies Somers arts fair against any claim, loss or damage of whatever nature or cause however occurring and whether directly or indirectly relating to entered artworks or their delivery to the buyer.
  7. It is the responsibility of the artist to ensure suitable insurance covers are enacted for the duration of the event including the period to cover shipping.

Copyright/ reproduction

  1. By entering artwork into the Somers arts fair, the artists agrees that Somers arts fair may use the artist’s image(s) to promote Somers arts fair for the current exhibition and future promotion of the event.

Dispute resolution

  1. In the event of a dispute arising regarding the interpretation of these terms and conditions, the matter will be referred to the principal, Somers primary school and the decision of the principal will be final and binding on all parties.
